Washington Consumer Health Data Privacy Policy

This notice supplements the OPTAVIA Privacy Policy (“Privacy Policy”) and applies to personal data defined as “consumer health data” subject to the Washington State My Health My Data Act (“MHMDA”).

Consumer Health Data We Collect

As stated in Section II of the Privacy Policy, the data that OPTAVIA LLC (the “Company”) collects depends on the context on your interactions with the Company and the choices that you make (including your privacy settings), the features that you use, your location, and applicable law. Since consumer health data is defined broadly, many of the categories of data the Company collects could also be considered consumer health data.

Examples of “Consumer Health Data” may include:

  • Biometrics data, heart rate, blood pressure, clinical laboratory (blood work) measurements, Activity level, steps per day, dietary preferences, dietary, nutrient intake, protein intake, dietary supplement intake, fluids consumed, body measurements, body weight, weight metrics, BMI metrics, goal weight, body composition, including muscle and fat mass percentage, health conditions, medical history, symptoms, integration into Health Apps and the OPTAVIA App, and medications such as whether you are taking medically supported weight loss medications.

Sources of Consumer Health Data

As described further in the Privacy Policy, we collect personal data (which may include consumer health data) directly from you, with your interactions with our services, and from third parties, such as our affiliates, business partners, and independent coaches.

Why the Company Collects and Uses Consumer Health Data

We collect consumer health data for the purposes described in the Privacy Policy. Primarily, we collect and use consumer health data as reasonably necessary to provide you with the products or services that you have requested or authorized.

We may use consumer health data for other purposes which we give you choices and/or obtain your consent as required by law (e.g. advertising or marketing purposes).

The Company’s Sharing of Consumer Health Data

The Company may share each of the categories of consumer health data described above for the purposes detailed in the Privacy Policy. In particular, we may share personal data, including consumer health data, with your consent or as reasonably necessary to complete any transaction or provide you with any product or service that you have requested or authorized. Additionally, we may disclose data when we believe that doing so is necessary to comply with applicable law or to response to a valid legal process.

Third Parties with which the Company Shares Consumer Health Data

  • Service providers. Vendors or agents (“processors”) working on the Company’s behalf may be able to access consumer health data for the purposes described above.
  • Business partners and collaborators. We may share consumer health data with other companies, for example, where you use a service that is jointly operated with another company or where you use our services to interact with another company.
  • OPTAVIA Coaches. We may share consumer health data with your OPTAVIA Coach to provide you with the products or services that you have requested, or otherwise with your consent. Coaches who receive your consumer health data have agreed not to share your information with any third parties and are obligated to observe the intent of this Privacy Policy under the terms of their Independent OPTAVIA Coach Agreement with the Company.
  • Financial institutions and payment processors. When you make a purchase or enter into a financial transaction, the Company will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
  • Parties to a corporate transaction. The Company may disclose consumer health data as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.
  • Affiliates. The Company enables access to data across our parent company, subsidiaries, affiliates, and related companies.
  • Government agencies. The Company may disclose data to law enforcement or other government agencies when the Company believes that doing so is necessary to comply with applicable law or respond to a valid legal process.
  • Other third parties. In certain circumstance, it may be necessary to provide data to other third parties, for example, to comply with the law or to protect our rights or those of our customers.
  • Other users and individuals. If you use our services to interact with other users of the services or other recipients of communications, we will share data, including consumer health data, as directed by you and your interactions.

How to Exercise Your Rights

MHMDA provides certain rights with respect to consumer health data, including rights to access, delete, or withdraw consent relating to such data, subject to certain exceptions.
